Mr. Schmit is Special Counsel in the Firm's labor and employment practice group. He joins the Firm from Damon Morey, LLP, where he practiced for 40 years, previously having served as Chair of that firm and head of its Labor & Employment department. Mr. Schmit has represented private, public and not for profit employers across a broad spectrum of industry sectors. He concentrates his practice  in the areas of labor relations, contract negotiations, arbitration proceedings, employment discrimination litigation, wrongful termination actions and safety and health matters.

Mr. Schmit's litigation experience includes actions to enjoin strikes, proceedings to compel or stay arbitration and the defense of employment discrimination, wrongful termination and unfair representation cases. In addition to appearing before the Unites States Supreme Court in a National Labor Relations Act matter, he has litigated employment disputes before numerous administrative agencies including the National and New York State Labor Relations Boards, the New York State Public Employee Relations Board, the Equal Employment Opportunity Commission, the New York State Division of Human Rights, the United States Department of Labor and the Occupational Safety and Health Review Commission.

 Memberships & Offices:

Prior to practicing law, Mr. Schmit served in the United States Army. He is a member and past president of the Industrial Relations Research Association of Western New York (now known as LERA), the New York Management Attorney's conference and the Erie County and New York State Bar Associations. An adjunct faculty member of Cornell University's School of Industrial and Labor Relations, he is listed in Best Lawyers in America, was named an Upstate New York's Super Lawyer ( 2009)  and "Who's Who in Law"(2005) by Business First of Buffalo.
