Jaeckle Fleischmann's E-Discovery & Records Management practice group serves as litigation counsel to clients faced with identifying, producing and disclosing electronic records in complex litigation proceedings, and assists clients in their efforts to see that their data collection and document management procedures comply with laws and regulations pertaining to their business. The practice group is comprised of attorneys from multiple legal disciplines and technical backgrounds who are called upon based on a client's particular industry and unique situation.
The courts have uniformly concluded that electronic data is subject to disclosure to one's opponent in litigation. When called upon to produce electronic data, business executives and litigants have found the process of culling archives and producing hard copies as well as electronic versions of documents an uncertain proposition. Litigants and attorneys can imperil their legal interests by failing to adequately evaluate and develop a plan for the management and disclosure of electronic information during the course of case discovery, and the courts have dealt harshly with parties who fail to comply with demands for such information.
Investing in the development and memorialization of procedures and protocols for information management quickly translates into tangible benefits, enabling the efficient retrieval of information when your business must quickly evaluate and respond to issues as they arise. At the same time, unnecessary costs associated with archiving information that does not need to be preserved may be eliminated.
