Certification Procedures
o Now: Employers have the right to insist upon a secret ballot election to determine whether a majority of employees wish to be represented by a particular labor organization.
o EFCA: No election will be held if the union presents authorization cards signed by a majority of employees in an appropriate bargaining unit.
